GENERAL
Intelecare Compliance Solutions, Inc. (hereinafter "Intelecare") has created this Privacy Policy in order to demonstrate our resolute commitment to protect your privacy and personal information. It further describes our information gathering and dissemination practices.

INTELECARE WILL NOT SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH ANY THIRD PARTY WITHOUT YOUR CONSENT UNLESS REQUIRED BY LAW OR WHEN NECESSARY TO PROTECT OUR RIGHTS AND/OR TO COMPLY WITH A JUDICIAL PROCEEDING, COURT ORDER OR LEGAL PROCESS SERVED ON US. WE AND OUR PARTNERS MAY, FROM TIME TO TIME, SEND YOU INFORMATION THAT MAY BE OF INTEREST TO YOU BASED ON YOUR REGISTRATION PROFILE AND ACTIVE REMINDERS. YOU CAN OPT-OUT OF RECEIVING THESE COMMUNICATIONS AT ANY TIME.

Intelecare's website may contain links to other websites. Intelecare is not responsible for the privacy practices or the content contained on other websites. Although every effort has been made to choose those sites and organizations that share our philosophy and strict guidelines, please read the privacy policies of those sites carefully if you have any concerns about your privacy.

INFORMATION THAT WE COLLECT FROM YOU AND HOW WE USE IT
Intelecare's registration form requires that you provide us with contact information (e.g., name, phone number and email address) and select demographic information (e.g., location, gender and age) in order to use our services. We also collect medication information to develop the requested reminder messages. We use this information to send you the reminder messages you create, to contact you regarding updates or with other information regarding our services, and to provide you with materials relating to your personal areas of interest identified within your user account after registration. It is your responsibility to maintain the accuracy of your contact and other personal information in your user account so that we may continue to send you reminders or other materials you have requested.

Intelecare may share aggregate information regarding our registered users with marketers; however, we never share information that identifies a specific user without that user's consent. We do, however, reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on Intelecare.

Once logged on to Intelecare's website, your Internet Protocol ("IP") Address is relayed to Intelecare. Your IP Address contains basic information about your computer including, but not limited to, geographic location, operating system, browser type and version. We use your IP Address to help diagnose problems with our server, and to administer our website.

From time to time we may offer users the opportunity to participate in online surveys. Our online surveys may ask users for demographic information (e.g., age) and psychographic information (e.g., what television shows you watch) to better help us understand the answers submitted among other similar individuals in similar geographic or demographic areas. We use this data to tailor your experience and to provide content and services that we believe will be of interest to you. This information may be shared with marketers on an aggregate basis to help improve our communications to you, but information that identifies a specific user will not be shared.

HOW WE SAFEGUARD THE INFORMATION YOU PROVIDE TO US
Intelecare has implemented various security measures to protect against the unintended loss, disclosure, misuse or alteration of the information under our control.

  1. We do not store cookies on your machine. Cookies are small pieces of computer code that identify you and your computer. Many sites use cookies to identify you when you come to a website, especially if the site is personalized for you. Because cookies can allow other people access to your information, we have decided not to use them.
  2. You must log in on the Intelecare website any time you want to access your personal information. In order to view your account on Intelecare's website, you will be asked to log in with a unique password. This password is personal to you and should not be shared with anyone. If you leave the Intelecare website, you should be sure to log off. However, in the event that you forget to log off and leave your computer or if there is no activity on the Intelecare website for more than 15 minutes, you will automatically be logged off and will be asked again to log in with your password.
  3. All of your personal information is encrypted when it is stored in and transmitted by our system. "Encrypted" means that it is scrambled with special complex codes so that no other computer can read it.
  4. You have full control over your information. You can change any piece of information in your password-protected My Profile section at any time.
  5. Intelecare monitors the limited number of our employees that can potentially access your information. As a part of general maintenance procedures that ensure the security of your personal information and the stability of our servers, there are a limited number of employees that may have access to our user database. These employees are required to abide by our Privacy Policy and are subject to strict disciplinary action including but not limited to termination of employment if this policy is breached; Intelecare shall also alert the appropriate authorities if any actions warrant such notification.
  6. We will never ask for your password in an unsolicited phone call or email- do not ever give it out.
  7. All the information Intelecare collects is hosted on secure servers stored behind firewalls that are backed up regularly to ensure minimal loss of information in the event of a system failure or disaster.

Unfortunately no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, it is in our interest to make best efforts to ensure its security on our systems.

NOTE THAT INTELECARE CANNOT PROTECT ANY INFORMATION ONCE IT HAS BEEN TRANSMITTED TO YOU. IF YOU SHARE A PHONE NUMBER OR EMAIL ADDRESS WITH ANYONE ELSE (FOR EXAMPLE, A FAMILY MEMBER), INFORMATION TRANSMITTED TO THAT PHONE OR EMAIL ADDRESS MAY BE ABLE TO BE ACCESSED BY THAT OTHER PERSON. YOU SHOULD CONSIDER ANY SHARED USE WHEN CREATING YOUR REMINDER ON THE INTELECARE SYSTEM.

THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT ("HIPAA") AND THE HEALTH INFORMATION FOR TECHNOLOGY FOR ECONOMIC AND CLINICAL HEALTH ("HITECH") ACT

Although many people assume that HIPAA protects all personal health information, however obtained and wherever stored, HIPAA is actually somewhat limited in its applicability. HIPAA governs only "covered entities" and their "business associates." Covered entities under HIPAA include (i) health plans (insurance companies, HMOs, etc.); (ii) health care clearinghouses (entities that convert health information into or out of standard formats for billing or other purposes); and (iii) most health care providers (physicians, hospitals, etc.). Business associates are entities that contract with covered entities to provide certain services that involve the use or disclosure of individually identifiable health information.

Intelecare is not a covered entity under HIPAA but does, in some circumstances, act as a business associate. In such circumstances, Intelecare will comply with the rules promulgated by the Department of Health and Human Services under both HIPAA and HITECH for business associates, including the rules relating to security of personal health information and requiring notification of security breaches of unsecured protected health information. CHILDREN'S GUIDELINES
Intelecare's website has not been built or designed for children, nor is the site directed toward children. Although children may use the site, they should not do so without the guidance and approval of a parent or guardian. Although we do not intend to collect personal information from children, we do intend to comply with state and federal law, including, without limitation, the Children's Online Privacy Protection Act, in the event a child provides such information to us.

Please note that we have not included any safeguards to protect a child's privacy, like parental notifications or approvals. If you notice that your child has received information you believe is inappropriate, please contact our individual service department to have your child's name removed from our database. You can reach our individual service department by:

  1. Sending an e-mail message to remove@intelecare.com with the name and date of birth of the child whose information should be deleted from our database;
  2. Sending a letter with the name and address of the child whose information should be deleted from our database to the following postal address:

CHOICE/OPT-OUT
Intelecare solicits from you areas of interest when you register for our services. Intelecare and its partners may then provide you with targeted materials that relate to the areas that you have identified. You can Opt-Out of receiving these additional materials by de-selecting that option in My Profile or by contacting our individual service department by:

  1. Sending an e-mail message to remove@intelecare.com simply placing REMOVE in the subject line;
  2. Sending a letter requesting to be removed from the program to:

CORRECT/UPDATE
You can update your information in My Profile any time by logging in to your account and by selecting the My Profile link. These links are located on the top right hand side of every page when logged in to the system.

Notification of Changes
If Intelecare decides to change its privacy policy, we will post those changes on the Intelecare website so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

NOTE: IF YOU DO NOT AGREE WITH THE MANNER IN WHICH INTELECARE WILL COLLECT AND USE YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY, PLEASE DO NOT USE THE SITE OR THE SERVICES IT OFFERS.
